General Terms and Conditions

These General Terms and Conditions, governed by French law, set forth the procedure applicable to any request for the issuance of a certificate of authenticity.

1. Man Ray International Association

1.1 Founded in 1990 by Juliet Man Ray, the Man Ray International Association, governed by the French Law of 1901, is dedicated to preserving, deepening knowledge of, and promoting the work of Man Ray. Since 2004, the Association has been chaired by Marion Meyer, a member of the European Chamber of Art Experts (C.E.C.O.A.) since 1988. The opinions issued by the Association are independent and impartial; they are based on the archives held by the Association, the expertise of its members, and the information available at the time of examination.

1.2 The Man Ray International Association issues certificates of authenticity and may, where appropriate, render a negative opinion.

2. Applicants for Certification

Any natural or legal person may apply for a certificate, whether they are the owner of the work or acting on behalf of the owner, particularly in the context of a sale. The applicant undertakes to comply with the opinion issued and, where applicable, to ensure that their representative also complies with it.

3. Presentation of the Work

3.1 The applicant must provide the Man Ray International Association with all documents and information necessary for the examination of the work, including in particular:

·       A complete description of the work (title, technique, signatures or inscriptions, dimensions, provenance, ownership history, exhibitions and publications, together with any available supporting documentation).

·       High-quality, professional-grade, high-definition digital color photographs, free of rights, showing the front and back of the work as well as relevant details.

The Man Ray International Association reserves the right to take its own photographs if necessary. All documents and images submitted or produced may be retained and freely used by the Association, including for publication purposes.

3.2 Examination of the work will begin only after full payment of the invoice, acceptance of these General Terms and Conditions, and receipt of all required documents and materials.

4. Examination of the Work

4.1 The Man Ray International Association examines the work on the basis of the documents and photographs provided. At its request, the applicant must make the work available for examination at the Association’s headquarters (19 rue Lagrange, Paris) or at any other agreed location. Transport, packaging, insurance, and any handling, including the possible removal of frames or bases, are at the applicant’s expense.

4.2 The applicant undertakes to insure the work during transport and examination. The Man Ray International Association cannot be held liable for any damage occurring during transport, storage, or examination.

5. Examination Fees

5.1 Fees are set as follows:

·       Paintings (oil or acrylic, all supports): €1,700

·       Drawings and watercolors (and similar techniques, all supports): €950

·       Objects and sculptures (originals, replicas, variants, editions, and casts), including jewelry, chess sets, and furniture: €950 (included in the catalogue raisonné in preparation)

·       Photographs: €1,700

·       Lithographs: €250

5.2 As the Man Ray International Association is exempt from VAT pursuant to Article 293 B of the French General Tax Code, invoices indicate amounts exclusive of tax, followed by the statement: “VAT not applicable.”

6. Examination Conclusions

The opinion issued by the Man Ray International Association may:

1.     Confirm that the work is authentic and by the hand of Man Ray;

2.     Confirm that the work is not authentic and cannot be attributed to Man Ray;

3.     State that no conclusion can be reached regarding the attribution of the work.

The Man Ray International Association may, at any time and at its sole discretion, revise its opinion.

7. Works Not Authenticated

If the Man Ray International Association refuses to issue a certificate, it will communicate the reasons to the applicant. The work will be returned, and the applicant undertakes not to use the name Man Ray or to suggest that the work could be attributed to him.

8. Limitation of Liability

8.1 In the event of a dispute, the parties agree to seek an amicable expert appraisal before initiating any legal proceedings.

8.2 The Man Ray International Association cannot be held liable for any loss of value resulting from a refusal to certify. The applicant waives any liability claims on this basis.

9. Governing Law

This agreement is governed by and construed in accordance with French law.
